1. The scope and validity of the terms and conditions

1.1 The terms and conditions are applicable to all legal relationships, which arise between persons and owner of the Mobilyx.se purchasing environment (hereinafter: Mobilyx), Knaitek OÜ, upon purchasing of products through the Mobilyx store. 
1.2 In addition to these terms and conditions, the legal relationships, which arise upon purchasing of products through Mobilyx store, are regulated by the legislation applicable in the Republic of Estonia. 
1.3 Knaitek OÜ shall reserve the right to amend and complement these terms and conditions based on the development of Mobilyx store and in order to ensure better and more secure use of the store. Any amendment or complementation of the terms and conditions or the price list shall be announced on the website www.Mobilyx.se. The amendments and complementation of the terms and conditions or the price list shall become valid upon publishing of the amendment or complementation on the website www.Mobilyx.se. If you have submitted an order prior to entry into force of amendments to the terms and conditions, the terms and conditions, which were in force at the moment of sending the order shall be applied to the legal relationship, which has arisen between you and Knaitek OÜ, unless established otherwise by the law or by these terms and conditions.

2. The prices

2.1. In the case of timely payment of the amount specified in the invoice, the prices of Mobilyx shall be applicable pursuant to the provisions of Article 4. 
2.2. All prices are inclusive of Estonian value-added tax of 20%

3. Shopping cart and completion of the order

3.1. The number of products in the shopping cart can be changed. You can also change the amounts of the products ordered. To confirm any changes made, please click ‘Update shopping cart’ (‘Uuenda ostukorvi’). To continue to submit your order, please click ‘Next’. You will be directed to the page where you can submit the details of the ordering party. 
3.2. On the page of the details of the ordering party, please enter the requested information and click ‘Continue shopping’. You will be directed to the page, on which you can confirm your order and choose the payment method. 
3.3. Please fill in the fields on the page for submitting the details of the ordering party and on the page for confirming the order carefully, as the quick and smooth delivery of the products purchased by you depends on the accuracy and correctness of the information. 
3.4. The contract for sale of the products shall be deemed entered into (entry into force of the Contract) upon receipt of the amount due based on the order confirmation on the bank account of Knaitek OÜ.

4. Payment for the products
4.1. To make the payment, please select your preferred payment method on the order confirmation page. 

5. Delivery and handing over of the products

5.1. The products shall be delivered to you after entry into force of the Contract pursuant to Article 3.4 of the terms and conditions at a time agreed with you in advance by calling the number provided by you upon submitting the order. The delivery time of the electronics ordered shall be 5-7 working days, in exceptional cases, up to 14 working days.
5.2. The courier company shall deliver the products within the period specified under the description of the product.
5.3. If the product, which you have ordered, is not available in the warehouse, must be ordered from the supplier separately, and it is clear that the product cannot be delivered within the delivery period specified under the description of the product, and in other cases, in the case of which the product cannot be delivered by the delivery date, which Knaitek OÜ is not responsible for, we shall notify you thereof by the telephone number or e-mail address provided by you upon submitting the order within 2 working days after entry into force of the Contract pursuant to Article 3.4 of the Terms and Conditions, and also notify you of the actual delivery date of the product ordered by you. If you lose interest in purchasing the product due to the longer delivery date, you may cancel the order (see Articles 6.1 and 6.3) and the amount paid by you (including the cost of transport) shall be refunded. 
5.4. When the products ordered by you have been handed over to the courier company, the courier company shall contact you in advance to specify the delivery time of the products. 
5.5. The courier company shall deliver the products to the address provided by you upon submitting the order. The delivery address cannot be changed after submission of the order. 
5.6. To prevent any delays or inconveniences in the delivery of the products, please make sure that you provide accurate contact details upon submitting the order. Knaitek OÜ or the courier company shall not be held liable for delays or inconveniences in the delivery of the products, which arise due to the inaccuracy or incorrectness of the details provided by you upon submitting the order. 
5.7. The courier shall hand the products over to you with a delivery note. We strongly advise you to inspect the parcel prior to signing the delivery note and add a respective comment to the courier’s delivery note in the case of detecting any external damages. Please report any products, which have arrived in a damaged packaging by e-mailing info@mobilyx.co.uk. The products, which are delivered in a packaging damaged by the courier company, shall be replaced.
5.8 The list of our delivery partners:

5.9 Upon receipt of the shipment, please make sure at the courier’s presence that the packaging of the shipment is in a good condition and is not externally damaged (e.g., signs of the parcel having been opened, kneading, etc.), and whether the number, quality, and selection of the products are in compliance with your order.

In the event of detecting an external damage, or a discrepancy between the number, quality, or selection of the products ordered and delivered, the recipient or an authorized representative of the recipient shall refuse to accept the shipment. In this case, the recipient or an authorized representative of the recipient shall send an instrument of inspection of a private shipment, which shall include all details of the detected discrepancy.

A shipment shall be deemed delivered when the shipment is accepted by the recipient or an authorized representative of the recipient and the delivery note is signed (on paper or an electronic data medium) without adding comments; the products shall be deemed delivered in a packaging, which is in a good condition, the number, quality, and selection of the products shall be deemed compliant with the terms and conditions of the contract for purchase and sale, and any additional services, which have been specified on the delivery confirmation provided a data medium or on paper, shall be deemed properly provided, unless proven otherwise.

6. Cancellation of orders and returning of products

6.1 We do not accept cancellation or returnes from business clients unless its agreed by additinal sales terms or agreement.
6.2 Return address: Knaitek OÜ, GSM: +372 5017568, Sõpruse pst 145, Tallinn 13417, Estonia. The ordinary expenses of returning the product shall be covered by the consumer.

7. The warranty and returning of non-conforming products

7.1. Manufacture shall be held liable for the non-conformities or deficiencies of the products, which are found up to 2 years after delivery of the products to you. The expenses related to transportation shall be covered by the consumer.
7.2. Manufacture  shall not be held liable for: 
1) Deterioration/damaging of the goods, which has occurred at your fault. 
2) Any deficiencies, which have arisen as a result of improper use of the product. 
3) Normal physical wear and tear of product, which has occurred as a result of ordinary use. 
7.3. Warranty repair works shall be performed at a service point, which has been authorized by the manufacturer. In the event of the absence of an authorized service point, the warranty repair works shall be performed through the manufacturer’s factory.
7.4. In order to have warranty repair works performed, the product, which is returned, shall be accompanied by a brief description of the nature of the problem and description of how the problem was detected.
7.5. The customer shall deliver a problematic device or a device, which requires warranty repair works, to the authorized service center of the respective manufacturer at the customer’s expense
7.6 Product information shall be checked and updated on a regular basis. The information may have changed after your last visit. The product information provided at Mobilyx.se store may include inaccuracies due to insufficient information provided on the product data sheets issued by the manufacturers. In such cases, Mobilyx store shall not be held liable for the accuracy of the product information. If possible, we advise you to check the product information provided on the website of the manufacturer before placing your order.
